These Terms & Conditions ('Terms') govern your use of the website www.aradhanakakardesigns.com and your engagement with the interior design and architectural design services provided by Aradhana Kakar Designs Studio ('the Studio', 'we', 'us', or 'our'). By accessing our website or entering into a project engagement with us, you agree to be bound by these Terms.
Please read these Terms carefully. If you do not agree with any part of these Terms, please discontinue use of our website and services.
Aradhana Kakar Designs Studio is a luxury interior design and architecture practice based in Chandigarh and Panchkula, India. We specialise in residential interior design, commercial interior design, architectural design, space planning, furniture design and curation, kitchen and bathroom design, and brand collaboration for furniture and lifestyle brands. Our services are delivered through a formal client engagement process described in these Terms.
You are permitted to access and use this website for personal, non-commercial purposes — including browsing our portfolio, reading our blog, and submitting an enquiry for design services. Any commercial use of website content, including design concepts, photographs, or text, is strictly prohibited without our written permission.
You agree not to:
We strive to keep our website available at all times, but we do not guarantee uninterrupted or error-free access. We reserve the right to suspend, modify, or discontinue the website or any part of it at any time without notice.
All design and architectural services are provided under a formal project agreement, which is executed between the Studio and the client prior to commencement of any billable work. The project agreement specifies the scope of services, deliverables, project timeline, fees, and payment schedule. These Terms apply in addition to, and do not override, your project agreement.
Our design services may include, but are not limited to:
The specific services included in your engagement are defined in your signed project agreement. Services not listed in the agreement are considered out-of-scope and subject to a separate fee.
To enable us to deliver services effectively, clients are expected to:
Promptly inform the Studio of any material changes to the project brief, budget, or timeline
Our design fees are quoted on a project-by-project basis, based on scope, complexity, project size, and services required. Fees are communicated in the project proposal and confirmed in the signed project agreement. We reserve the right to revise fees if the project scope changes materially from the original brief.
Unless stated otherwise in your project agreement, our standard payment schedule is:
Payments are due within 7 working days of invoice issuance unless agreed otherwise. Delayed payments may attract interest at 12% per annum and/or result in a suspension of design work until dues are cleared.
Where the Studio manages furniture, material, or fixture procurement on behalf of the client, a separate procurement budget will be agreed. All procurement amounts are the client's direct costs and are distinct from the Studio's design fees. The Studio charges a procurement management fee as specified in the project agreement.
All fees are quoted exclusive of GST (Goods and Services Tax) unless explicitly stated otherwise. GST at the applicable rate will be added to all invoices in accordance with Indian tax law.
Out-of-pocket expenses incurred during project execution — including travel to project sites outside Chandigarh/Panchkula, courier charges, printing costs, and third-party site survey fees — are billed to the client at cost, with receipts provided.
All design drawings, architectural plans, concept boards, 3D renderings, mood boards, material schedules, specifications, and creative work produced by the Studio in the course of a project remain the intellectual property of Aradhana Kakar Designs Studio unless otherwise agreed in writing. This intellectual property is protected under the Copyright Act, 1957 (India).
Upon full payment of all design fees, the Studio grants the client a non-exclusive, non-transferable licence to use the design drawings solely for the purpose of executing the agreed project at the specified site. This licence does not permit the client to:
The Studio retains the right to photograph completed projects and use such photographs, descriptions, and design details in its portfolio, website, social media, press features, award submissions, and marketing materials. Client identities and personal information will not be disclosed without express written consent.
All content on this website — including text, images, 3D renders, design concepts, and brand material — is owned by or licensed to Aradhana Kakar Designs Studio. Unauthorised reproduction, commercial use, or distribution of website content is an infringement of our intellectual property rights and may be subject to legal action.
Both the Studio and the client agree to keep confidential all information disclosed during the project that is reasonably understood to be confidential — including the client's personal and financial information, project brief details, site information, and design deliverables. This obligation of confidentiality continues for a period of 3 years following the conclusion of the project.
The Studio may refer to the existence and general nature of a completed project in its portfolio and press communications but shall not disclose client-specific confidential information without consent.
Design revisions within the agreed number of revision rounds (as stated in the project agreement) are included in the design fee. Revisions beyond the agreed rounds, or changes to the project brief that require significant rework of already-approved designs, will be treated as a scope change and billed at our prevailing hourly or day rate.
Any client-initiated change to the approved design after production or procurement orders have been placed may result in cancellation charges from suppliers. The Studio will communicate such risks before implementing approved designs and cannot be held liable for supplier-imposed cancellation or restocking charges.
Project timelines are estimates based on the agreed scope and are set out in the project agreement. Timelines are contingent upon timely client feedback, payment, supplier lead times, site readiness, and contractor performance — factors that are partially or wholly outside the Studio's control. The Studio is not liable for delays caused by third-party contractors, import or supply chain disruptions, or client delays in approvals and payments.
Significant scope changes, client-requested pauses, or force majeure events (see Section 11) may require timeline revision, which will be communicated in writing.
If you wish to terminate the project engagement, you must notify the Studio in writing. Upon cancellation:
The Studio reserves the right to terminate a project engagement with written notice in the event of:
In the event of termination by the Studio, fees for work completed to date will be due and payable. The Studio shall have no further obligation to the client.
To the fullest extent permitted by Indian law, the Studio's total liability to the client for any claim arising from design services, whether in contract, negligence, or otherwise, shall not exceed the total design fees paid by the client to the Studio for the specific project to which the claim relates.
The Studio shall not be liable for:
Neither party shall be held liable for failure to perform obligations under a project agreement where such failure is caused by events beyond reasonable control — including but not limited to natural disasters, floods, pandemics, government lockdowns, import restrictions, nationwide material shortages, or supplier insolvency. In such events, timelines will be revised, and both parties will act in good faith to minimise disruption to the project.
In the event of a dispute arising from a project engagement or these Terms, both parties agree to first attempt resolution through good-faith negotiation. If resolution is not achieved within 30 days of written notice of the dispute, either party may refer the matter to mediation before a mutually agreed mediator in Chandigarh, India.
If mediation fails, disputes will be subject to the exclusive jurisdiction of the Courts of Chandigarh, India, under the laws of India.
These Terms and Conditions and any project agreement entered into with the Studio are governed by the laws of India, specifically applicable laws in the state of Haryana / Union Territory of Chandigarh. Any legal proceedings shall be brought exclusively before the competent courts of Chandigarh.
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions of these Terms shall continue in full force and effect.
The Studio reserves the right to update these Terms & Conditions at any time. Updated Terms will be published on our website with a revised effective date. Continued use of the website or engagement with our services following such updates constitutes acceptance of the revised Terms. For active project engagements, changes to the Terms will not affect obligations already agreed in a signed project agreement.
